1) CONTACT INFO
It is your responsibility to make sure that Desire Space has a record of your current email address that you regularly check. To do this send an email to the sales department with your username and your email address if it is different from the one that you signed up with.
2) BANDWIDTH USAGE
If you exceed your bandwidth quota for your website hosting, reseller hosting, or dedicated hosting plan, then you will pay $0.50 per 1,000 MB of transfer that you are over. If you exceed your limit for 2 concurrent months on a website hosting, or reseller hosting plan, then you must upgrade to a higher plan.
3) CONTENT
Desire Space does not allow any illegal content or material which you do not have copyright permission to use, to be kept on our servers. This includes anything unlawful according to state or federal laws within the United States of America. You are also not allowed to place content on our servers which could result in civil liability in any form. Desire Space does not allow content which may be in breach of Desire Space's providers' own terms of service, you will be notified if there are any problems with the content hosted on your account.
4) RESELLERS
It is the responsibility of reseller account holders to provide technical support to their clients. Reseller account holders are also responsible for insuring that their clients do not violate Desire Space's terms of service.
5) SPAM / MASS EMAIL
We have a zero tolerance policy on SPAM. This means if you use our resources to send out unsolicited email or newsgroup postings your account will be closed without refund. We will also close your account without refund if you use SPAM to advertise a website located on our servers whether the SPAM was sent from our servers or not. You may also be held liable should liability result from such actions. Mass emailing is also not permitted (i.e. you can not send email to a large email list or promote a site hosted with Desire Space in a mass email).
6) PAYMENT
Payment is due every 30 days. Our system will notify you a few days before the invoice is due. For website hosting and reseller hosting plans, if the invoice is not paid within 10 days of the due date, your account may be suspended, after a further 30 days your account may be terminated if the invoice is still unpaid. For dedicated hosting plans, if the invoice is not paid within 3 days of the due date, your server may be taken offline. If you use more than your transfer quota on your website hosting, reseller hosting, or dedicated hosting plan, you will be billed at $0.50 per 1,000 MB that you are over the quota.
7) RESOURCES
Desire Space reserves the right to suspend any account if it is using more than its fair share of system resources. Such abuse causes harm to others on the network. The account may also be closed if measures are not taken to stop said resource abuse. This usually only applies to customers who run very CPU intensive programs on the server for a long time.
8) CANCELLATION
Desire Space may cancel your account immediately and without refund if you are found to be in violation of the above terms. If you wish to cancel your website hosting or reseller hosting plan please contact the sales department with your username and password at least 3 days before you are due to be billed again, for dedicated hosting plans you must give at least 15 days notice.
9) LIABILITY
Desire Space is not liable for material housed on its servers. Desire Space will cooperate with law enforcement officials regarding unlawful material and/or actions. There is no warranty regarding site backups/content loss or software/hardware/network failure.
10) MONEY-BACK GUARANTEE
If you order a website hosting or reseller hosting plan, you may cancel your service within 30 days and receive a full refund. This money-back guarantee does not cover any costs or services other than the basic monthly fee for the account. This guarantee does not include dedicated hosting services at all.
